Catch up: IPSE's latest webinar on next steps for IR35
With damaging changes to IR35 fast approaching, IPSE today hosted a webinar to assess the full impact and field questions from those affected.
As you are probably aware, the Autumn Statement confirmed from this April the rules around IR35 in the public sector will change – the end client or agency will have to assess IR35 status (aided by an “online tool”), and will be liable for employment taxes if they deem the “PSC” to be caught.
This afternoon’s interactive session saw IPSE’s Andy Chamberlain and Simon McVicker consider the political background to this decision, outlining the OBR’s concerns over the increasing rate of incorporations and the fall in tax receipts. They set out how contractors, agencies and payroll companies are likely to react to the change, and whether HMRC’s online tool will be ready by April.
The wider implications of the change were analysed, including the possibility of legal challenges to the new arrangements and whether this could later be applied to the private sector too. The pair discussed IPSE’s approach to tackling the change, highlighting that IPSE is taking legal advice on the possibility of taking a case to tribunal.
IR35 was not the only worrying announcement at the Autumn Statement. Changes to the Flat Rate VAT scheme were also considered in the lunchtime sessions, with a new 16.5% Flat Rate VAT rate set to come in from 1 April 2017.
