PCG Portal Terms & Conditions

The PCG Portal provides a mechanism to enable members of PCG to promote their company’s services, for members and associate members of PCG to post details of contract and project opportunities and for visitors to identify potential suppliers or employees

These Terms and Conditions apply to all who may visit or use the Portal.

Please read the following information carefully as it sets out the basis upon which access to the Portal ("Portal") and on-line services ("Services") is made available. By accessing the Site, You agree to be bound by these terms and conditions ("Terms").

Definitions

In these Terms and Conditions:

"PCG" refers the Professional Contractors Group Limited a company limited by guarantee whose registered office is 35 Ballards Lane, London N3 1XW

“Portal” means the web site at www.pcg.org.uk/portal

"Services" is the posting of company profiles, the submission of invitations to tender (ITT’s) and the ability for users to submit searches to locate companies with defined profiles or ITT’s, which might be of interest to the user.

"Member" means a full member of the PCG.

“Associate” means an associate member of the PCG

“Registered User” means anyone who has registered as a user of the Portal who is neither a member nor an associate.

“Visitor” means anyone who is not registered as a “User”

“User” means a member, an associate, a registered user or a visitor

GENERAL

1. Visitors will be able to view the Portal without first having to register as a User. Visitors will be able to run simple searches for Business Profiles, but no contact details for the Business found will be displayed.
2. There are four levels of access to the Portal
   1. Public : this allows visitors to search on Business Profiles, but shows no contact details
   2. Registered User : provides the above plus:
      it shows contact details for profiles
      it allows placing of an ITT
      it allows input of own Business Profile
   3. Associate: provides 1 and 2 above plus :
      additional reports and resources
   4. Member: provides 1,2 and 3 above plus
      Business Profile is included in searches (no other level of user is included in any search result)

3. These Terms and Conditions may be amended from time to time. We shall post a change notice on the Portal indicating the change and by continuing to access the Site, You shall be deemed to have accepted such change
4. These Terms and Conditions are governed by English Law. You hereby irrevocably submit to the exclusive jurisdiction of the English Courts.

OUR OBLIGATIONS TO USERS

1. We agree to use reasonable endeavour to retain the Portal as operational and error free. Certain technical difficulties may arise from time to time which may result in service interruption, therefore we can give no guarantee that the Portal will remain available for access at all times. Furthermore we cannot give any warranty or guarantee for the quality, accuracy, efficiency, completeness or performance of the Portal or the Service made available to you.
2. We are not liable for any loss (direct or indirect) including but not limited to loss of business opportunities or projects or loss of profits whether caused by our negligence or otherwise which arise out of the use of or inability to use the Portal or any of its contents or from any action or omission taken as a result of using the Portal.
3. We have no liability to Users for any loss, damage, costs, expenses or other claims for compensation arising from any information supplied by a User that is incomplete, incorrect, inaccurate or out of date.
4. We reserve the right at our discretion to suspend or terminate a Member’s or Associate’s or Registered User’s access to the Portal by e-mailing you to such effect.
5. PCG does not warrant that any details placed on the Portal, whether as company profiles or as an ITT, is complete or accurate. PCG therefore does not accept any liability to any users for any losses or costs incurred as a result of using or relying on information gained from the portal or from employing a company or individual as a result of information gained from the Portal.
6. Visitors cannot access ITT’s. Members, Associates and Registered Users can access and amend those ITT’s that they have raised themselves. Only Members can access ITT’s raised by other Users . PCG endeavours to ensure that access levels are set correctly and kept up to date but cannot guarantee this.

USER OBLIGATIONS

1. All Users agree not to use the Portal such that they cause the whole or part of the Portal and its services to be interrupted, damaged, rendered less efficient or in any way impaired.
2. All Users agree not to attempt to gain access to areas of the Portal beyond those areas detailed in these Terms and Conditions.
3. Members contact details gained from searching the Portal should only be used for the specific requirement that the User is seeking to fulfil. On no account should Members’ details be retained for later use, added to a Database(of any form), or passed on to a third party without the explicit permission of the Member in question.

ADDITIONAL OBLIGATIONS FOR PCG MEMBERS ASSOCIATES and REGISTERED USERS

1. Members and Associates and Registered Users are responsible for all use of the Portal made by them (or anyone else using member or associate member user name and password) and are responsible for maintaining the confidentiality of the password and user name and shall notify PCG immediately of any unauthorised use of these or any other breach of security. PCG have no responsibility should your user name and password be accessed by any third party.
2. It is essential that information provided by Members and Associates and Registered Users, when providing a profile or posting an ITT, is true and correct. Members and Associates and Registered Users are responsible for the accuracy of information that they supply and agree to update any material changes to such information promptly.
3. Access to company profiles placed on the Portal by members is based upon access levels which the member themselves determine and members must ensure that they have set the correct access level.

COMPLAINTS

1. Any complaint that Users have in relation to the Service offered by PCG on its Portal or about anything contained on the Portal should be emailed to PCG at portal@pcg.org.uk.

DISCLAIMERS

1. 2. Your use of the PCG Portal is at your sole risk. We give no warranty or guarantee as to the accuracy, completeness or relevance of the information available on the Portal and, to the fullest extent permitted by law, we exclude all warranties, conditions and other terms implied by statute or law with respect to the Services and Your use of the Portal. We shall have no liability to You other than as may expressly be provided for herein.
2. 3. We give no guarantee, warranty or undertaking that the Services will remain available, will meet your requirements, or that access to the Portal will be or remain secure uninterrupted or error free. It shall be Your responsibility to ensure that the Services and any products, services or information available through the Portal (or any Third Party Site) meet your specific requirements.
3. 4. Should you download any Material from the Portal then this shall be done at Your entire risk and You shall be solely responsible for any damage to Your computer, loss of data or other loss that results from such downloading.

COPYRIGHT

1. PCG owns all copyright and other intellectual property rights in relation to the material and content available on the Portal or which is sent to You by e-mail and in relation to the Services offered and the concepts reflected in the Portal ("IPR"). All Site design, text, graphics and software, source code and all other material on the Site are copyright PCG All rights reserved.
2. Material is available for Your personal use. You may retrieve and display Material from the Site on a computer screen, print individual pages in hard copy (but not photocopy them) and store such pages in electronic format on disk for a period of up to one month. . You are not entitled to reproduce, modify or in any other way use the Material without the prior written permission of PCG.

TRADEMARKS

1. The PCG Portal ® is our registered trademark and you agree that You shall not use, reproduce or display the it without our express written consent and that You do not obtain any rights in or to the trademark.

PRIVACY

1. We are committed to protecting your privacy, and working according to Data protection legislation.
2. The PCG Portal is covered by the PCG’s Data Protection Registration under the Data Protections Acts 1984 and 1998.
3. Company profiles may be accessed according to the access levels set by the member. Once a member has set their profile details to Public a specific subset of these details (Company Name, Contact Name, Services Provided only) may be viewed by any Visitor to the Portal.
4. The system logs details of who has viewed each profile and these details are made available to the owner of that profile.
5. ITT are only accessible by Members or by the User who generated the ITT.
6. Visitors can only access profiles and only those profiles to whom visitor access has been granted.
